This idea seemed strange until it was mentioned that it was a precedent. The state of West Virginia was formed during the Civil War when the citizens of the new state disagreed with the unconstitutional actions of the state of Virginia that seceded and formed a new state.

The need for a new California
The US Declaration of Independence of 1776, the Alta California Declaration of Independence of 1836, and the Sonoma Proclamation of 1846 declared the right of the people of Alta California and California to throw off the shackles of tyranny.
The present State of California is governed by a tyranny, comparable to that expressed in the above documents. Thus, the United States Declaration of Independence of 1776, the Constitution as adapted by the United States Congress in 1783, the Alta California Declaration of Independence of 1836, the Sonoma Proclamation of 1846, and the California State Constitution of 1848 mandate the Right, Responsibility, Duty the people suffering a long series of abuses and usurpations by a tyrannical government to abolish and establish a new government by the people and for the people under GOD.

“New States may be admitted by Congress into this Union; but no new states shall be formed or raised within the jurisdiction of any other state; nor can any State be formed by the union of two or more States, or parts of States, without the consent of the Legislatures of the respective States, as well as of Congress.”

The process of splitting the state
The precedent was set in 1861 when West Virginia seceded from Confederate Virginia as Virginia sought to secede from the Union. The process begins when the state legislature first votes to split the state. After the measure in the form of a resolution passes both the State Assembly and the Senate, it is submitted to Congress. Both the U.S. House of Representatives and the U.S. Senate must vote to pass a resolution to divide the state.
No state was brought into the Union that could not demonstrate its ability to govern itself. New California will demonstrate a system of governance modeled after the US Declaration of Independence, Constitution and Bill of Rights…
…New California will be the sixth largest state behind New York (bigger than Illinois and Pennsylvania). It is estimated that 25-27 seats in the US House of Representatives will go to New California. Old California will become the second most populous state behind Texas and ahead of Florida, losing 25-27 seats in the US House of Representatives.

Today, the state of New California sent its first two delegates to Washington DC
New California has taken a big step forward as the 51st state movement has just sent two emissaries to Washington DC to inform, educate and advocate for statehood.
Following the 10th Constitutional Convention in Anaheim, CA on January 13-14, 2023 and the adoption of the state constitution, delegates were chosen to go to Congress to advocate for statehood. There were 7 delegates, 5 of whom were chosen as delegates-representatives in the House of Representatives and 2 delegates-senators.
All were represented in the New California Legislature and were overwhelmingly elected by both the New California State Assembly and Senate.
First two in order
The first two to go to Washington DC are Patty Plumb from Shasta County and Joshua Disney from San Benito County.

Dear Mr. Chairman:
“The State of New California seeks admission into the Union of States known as the United States of America and requests that an Act of Admission be allowed to be passed on behalf of the citizens of the State of New California to create the 51st.St State.
State of New California seeks admission to the United States on an equal basis with other countries. The Constitution shall always be republican in form and shall not be inconsistent with the Constitution of the United States or the principles of the Declaration of Independence.
As of February 2017, the citizens of New California are exercising their constitutional right to form from the State of California under the process authorized and codified in Article IV. sections 3 and 4 of the United States Constitution. Fifty-six county boards of the State of New California were formed with the express purpose of creating the State of New California. When New California is formed, it will have a rural New California population of over 19 million people…………………
